Court petition highlights importance of transparency in public recruitment

Transparent and merit-based recruitment is one of the cornerstones of good governance. Public institutions are expected to uphold constitutional values by ensuring that recruitment processes are fair, competitive, and accessible to all qualified candidates.

A recent petition filed before the Employment and Labour Relations Court in Kakamega has drawn public attention to the recruitment process for the Chief Executive Officer of the Veterinary Medicines Directorate (VMD). The petitioner alleges that the recruitment exercise did not fully comply with constitutional and legal requirements governing public appointments and has asked the court to temporarily halt the process until the concerns raised are addressed.

Why Transparent Recruitment Matters

Public recruitment extends beyond filling vacancies—it is about strengthening public confidence in institutions. Every recruitment process should reflect the principles of:

  • Merit and equal opportunity
  • Transparency and accountability
  • Fair competition
  • Integrity in public service
  • Compliance with constitutional and legal standards

When these principles are upheld, institutions are better positioned to deliver quality services while maintaining public trust.

Issues Raised Before the Court

According to the petition, questions have been raised regarding the transparency of the recruitment process, the availability of information to the public, and whether the recruitment complied with constitutional principles governing appointments to public office. The petitioner argues that these concerns should be resolved before any appointment is finalized.

The court is expected to determine whether the recruitment process met the required legal standards and whether any corrective measures are necessary.

Strengthening Public Institutions

Strong public institutions rely on recruitment systems that are free from conflicts of interest and open to public scrutiny. Fair recruitment not only protects the rights of applicants but also ensures that qualified individuals are entrusted with leadership positions based on competence and integrity.

Respecting due process helps prevent disputes that may delay service delivery and reinforces confidence in government institutions.

APO’s Perspective

At Agents of Peace Organization (APO), we believe that accountability and transparency are essential pillars of sustainable development and peaceful societies. Public institutions should consistently uphold constitutional values by ensuring that recruitment processes are:

  • Open and transparent
  • Free from discrimination
  • Guided by merit
  • Accountable to the public
  • Conducted in accordance with the law

Promoting good governance strengthens institutions, encourages citizen participation, and contributes to a more just and equitable society.

Looking Ahead

As the court considers the issues raised in this petition, the outcome may provide valuable guidance on how public institutions can continue improving recruitment practices while safeguarding constitutional principles.

Ensuring fairness, transparency, and accountability in public appointments remains essential for building public trust and strengthening democratic governance.
